Terms of Use

The agreement

These terms are an agreement between you and Tomasz Migacz, the developer of TRACE (“we”, “us”), for using the TRACE iPhone app and this website. Apple’s Licensed Application End User License Agreement also applies to the app. If the two conflict, these terms apply to the extent the law allows. By using TRACE you agree to these terms. Our Privacy Policy explains how we handle your data.

TRACE is currently in beta. Beta versions may contain bugs, and features may change or be removed.

Your account

  • You must be at least 16 to create an account.
  • Keep your account secure. You’re responsible for what happens in it.
  • Your username must not impersonate someone else or be offensive. We may change or remove usernames that break these rules.

Walking safely

Always pay attention to your surroundings, traffic and local rules. Don’t look at your phone while crossing streets. Routes planned by TRACE, including smart routes, are suggestions based on map data. They may include roads without pavements, private ground, closed paths or places that aren’t safe to walk. Use your own judgement and don’t enter places you aren’t allowed to. TRACE is not a medical or fitness device, and distances, steps and times are estimates.

Your content

Your walks, profile and photo remain yours. You give us permission to store, process and display them only as needed to run TRACE, for example to show your profile and walk summaries to other users as described in the Privacy Policy. This permission ends when you delete the content or your account.

Community rules

Don’t use TRACE to harass, stalk or threaten anyone. Don’t upload photos or names that are offensive, sexual or illegal. Don’t cheat leaderboards with fake walks, and don’t interfere with the app or other people’s accounts. There is no tolerance for objectionable content or abusive users.

You can block anyone from their profile, and report a person or a walk from the ••• menu. We review every report within 24 hours and remove content, or suspend or close accounts, that break these rules. You can also report problems to support@tracewalks.com.

TRACE+ subscriptions

TRACE is free to use. TRACE+ is an optional subscription that unlocks extra features: smart routes, streak freezes and repair, full statistics, leaderboards, year in review, the heatmap, GPX export and map colour themes.

  • Plans: TRACE+ Monthly (1 month) at €3.99 and TRACE+ Yearly (1 year) at €24.99, or the equivalent in your local currency as shown in the App Store before you buy.
  • Free trial: new subscribers may get a 7-day free trial. If you don’t cancel at least 24 hours before the trial ends, the subscription starts and you are charged.
  • Payment: charged to your Apple ID account when you confirm the purchase.
  • Automatic renewal: the subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
  • Managing and cancelling: in iPhone Settings → your name → Subscriptions. Cancelling stops the next renewal. You keep TRACE+ until the end of the period you’ve paid for.
  • Refunds: Apple handles all payments and refunds, under Apple’s terms. You can request one at reportaproblem.apple.com.
  • Price changes: Apple will tell you in advance and, where required, ask for your consent.

TestFlight testers may receive TRACE+ for free during the beta.

Map data

Street and map data © OpenStreetMap contributors, available under the Open Database License. Map tiles from OpenFreeMap, based on OpenMapTiles. Map data may be incomplete or out of date.

Liability

We work hard to keep TRACE reliable, but we provide it “as is” and can’t promise it will always be available, error-free or accurate. To the extent the law allows, we are not liable for indirect losses, or for injury or damage from following routes or map information. Nothing in these terms limits liability that cannot be limited by law, such as for intent or gross negligence, or your rights as a consumer under the law of the country where you live.

Ending

You can stop using TRACE and delete your account at any time in Settings. We may suspend or end your access if you seriously or repeatedly break these terms. If we ever shut TRACE down, we will give reasonable notice.

Law and changes

These terms are governed by Polish law, without depriving you of the protection of mandatory consumer law in your country of residence. If we change these terms, we will update the date above and, for significant changes, tell you in the app.
